LHC restricts children from evicting parents under PPO. According to local news media, the Lahore High Court handed down a decision on a petition filed under the Parents Protection Ordinance (PPO) 2021 on Monday.
“A child if he is a tenant or house owner, could not evict parents from the house, and eviction of parents from the house will be an offense,” a judgment written by Justice Ali Baqar Najafi read.
LHC restricts children from evicting parents under PPO Ali Ikram filed a petition, which was heard by Justice Najafi.
“A child will be liable for a one-year jail term and fine over the eviction of parents,” according to the court verdict.
“Parents could remove offspring from their home at any time. A child must leave the house within seven days or face a jail term of one month,” the court said.
Muhammad Akram, Ali Ikram’s father, had reported that his son had kicked him out of the house. He had requested that his son Ali Ikram be prosecuted by the deputy commissioner.
The DC advised the father to file a complaint in the appropriate court. The deputy commissioner’s and appellate court’s verdicts were overturned by the Lahore High Court.
The court further ordered the DC to follow the court’s ruling in light of the applicable law.
The Parents Protection Ordinance (PPO) 2021, signed by President Arif Alvi in May, protects parents from being forcibly evicted by their children and makes the act punishable by a jail term, a fine, or both.
The PPO 2021 also prohibits children from evicting their parents if they own the property or have rented the space themselves.
Separately, if the parents want their children out of the house they own or have rented, the children will be held liable for failing to follow the instructions.
The children must leave their parents’ home within 30 days of receiving a written notice, and failure to do so may result in a 30-day jail sentence, a fine, or both.
Following a complaint from parents, the deputy commissioner of any district now has the authority to take action against the children.
