From a jurisprudential point of view, our justice system is weak to give justice to women and cannot protect women, and does not help women to get fair treatment. As this society is a male-dominated society. Such many rape cases occur daily and how many accused get arrested? Not one, same as the law enforcement institutes need to be more concerned about that and investigate properly but they do not investigate properly. Our legal system is negligent and hence, they blame the women not men even if the crime is committed by men. For example, Imran Khan our Prime Minister blames rape victims that they are wearing “very few clothes”, which is referred to as the “concept of purdah”. That is, in one sense he is actually defending the males who do such a shameful act. Hence Imran Khan, our respectable Prime Minister instead of finding out the accused (men) and teaching the society the norms to respect women, states that every fault is made by women, not by men.
So in that situation, women are not being supported or helped by the system but they are instead blamed so in clear terms there is no justice system. (How would our Prime Minister justify the rapes of 3 to 7 or 8 years girls who are properly dressed?) Anyhow, in such a society women do not get fair treatment by the institutions also, it’s the negligence of our legal system. There are many cases in which the accused was acquitted or freed, and victims do not get justice for example the case of Ms. Safia Bibi.
Feminist says that proper rights are not given to women in Pakistan. Such as the right to a fair hearing, the rule against bias etc. no one hears the problems of a girl properly, the whole system is biased because the majority is men and they do not want that anyone can be more powerful than them. There is injustice toward the women of Pakistan. Such as in distributive justice the jobs for women are very less in number and their participation in economic and political manner is next to nothing. Because women are mostly seen as child-bearer while men as breadwinners. In article 24 of the Pakistan constitution, full participation of women in national life is stated but it is only written in the constitution, and it is not properly implemented well. As no proper measure is taken to make a peaceful and workable environment for women, especially married women. It is obvious that if they will participate, our economy will be generating more wealth yet, women are entangled in cultural and honor limits and every year young girls are killed in the name of honor, which is no doubt a crime and injustice done towards them. Furthermore, we never see that a woman has become a Chief of Army Staff or a woman become a Chief Minister or is present in any other higher rank of office. Because there are very few men to work under the woman’s leadership.
Feminists say that a revolution will solve the problem, which in my opinion is probably not the solution to the problem. It will open the floodgates. For example, if women become powerful and dominate men then men will think to bring down the women and initiate a revolution for themselves. Therefore, society needs to be civilized and educated only then betterment will take place.
Same according to the Marxist feminist point of view; women from the elite class get many rights but women from the working/lower class do not get as many rights. Moreover, there is also economic injustice that women do not get more ‘quota’ (seats) to perform well in the economy of the country. Furthermore, there are some issues such as cultural boundaries or in rural areas where women even do not know their rights.
In the end, the government needs to increase the number of jobs for women so that they could participate more in every field. Furthermore in the rural areas government needs to develop more educational institutes so that women could get better knowledge about their rights. No doubt, the feminists are working hard for a change and the change is coming but slowly. The government needs to enforce the laws for the betterment of women. Moreover, the trial system, the investigation system, and other institutes need to be more concerned when they are checking or investigating women’s cases.
