INDIA: Karnataka High Court hears the Hijab case

Karnataka high court heard the arguments of the ‘ban on Hijab’ case. The polarizing arguments were taken on board. The freedom of religion is everyone’s right & they should practice it however they want but the opposite argument emphasized on educational institutions having their one fixed prescribed uniform.

Arguments on a batch plea took on challenge of the previous Karnataka high court order on banning hijab only in educational institutions. The court defended themselves saying that, “The religious right does allow one to practice it but what if an educational institute has a certain way of dressing, can one practice it there too?”, the justices Hemant Gupta & Sudhanshu Dhulia said in defense.

The opposite argument was about how religious priorities need to be up held at top & come under more important attention scrutiny than educational institutions. This might lead to a large section of society being deprived of education.

Additional Solicitor General (ASK) k M Nataraja unabashedly called the matter a compact & limited one. The court objected instantly, saying that “a student’s religious preferences do not get violated even if she wears hijab?”. To which ASK replied that “under the guise of religion, someone cannot get away by just saying that I’m entitled to do this, hence can break the discipline of an institution.”

This hearing was held to challenge Karnataka high court order on 5th February. The petitioners had just filed a request saying that wearing hijab is just an innocent act of righteousness & pure faith. Does not endorse any harm or religious Jingoism.

The final conclusion by the high court says that the Karnataka High Court dismisses the petition filed by a section of Muslims. Th limitation of hijabs is just a school limitation & is constitutionally permissible. The court took the shelter of Article 21 in Indian constitution.
