PHC D I Khan Bench suspends Acting VC of GU, undo the decision of asset distribution
Divisional Bench of Peshawar High Court, D I Khan suspended Professor Dr. Masroor Elahi, Vice Chancellor of Agriculture University, D I Khan, as Acting Vice Chancellor of Gomal University, suspending his powers and orders.
On Monday, the well-known lawyer of D I Khan Ahmed Ali Khan’s writ petition was heard by Justice Faheem Wali Khan and Shahid Khan of Divisional Bench of Peshawar High Court, D I Khan.
Petitioner Ahmed Ali Khan Advocate presented his stand before the honorable court that on September 19, 2022, Acting Governor KP/Chancellor GOmal University Mushtaq Ghani sent Vice Chancellor Gomal University Professor Dr. Ifthar Ahmed on forced leave for ninety days and appointed Vice Chancellor Agriculture University Professor Dr. Masroor Elahi Babar as Acting Vice Chancellor of Gomal University.
Ahmed Ali Khan argued that there is a conflict of interest between the two universities and in such a case, how can Prof. Dr. Masroor Elahi Babar do justice to Gomal University?
Ahmed Ali Khan also filed two CM applications (civil miscellaneous applications) along with the writ petition.

He said in his petition that Por. Dr. Masroor Elahi Babar should be immediately removed as acting Vice-Chancellor of Gomal University and in the meantime all actions taken by him should be suspended and the Senior Dean or Senior Most Professor of Gomal University should be appointed as the Vice-Chancellor.
He said that the appointment of Professor Dr. Masroor Elhi Babar is against the University Model Act of 2012.
In the second CM (civil miscellaneous application), it was requested from the court that in the light of the actions taken by the acting vice chancellor including the significant decision of the distribution of the assets of Gomal University, in which about 4000 students, buildings, animals and other agricultural assets should be transferred to Agriculture University, should be suspended.
Mr. Ahmed Ali Khan said in his argument that Gomal University’s assets and students will be transferred to Agriculture University and Gomal University will give salaries and benefits to the staff on which the division bench expressed surprise and said that the university already does not have salary to give to the employees and pension for the pensioners, how will it be able to remain active in this situation.
Amir Farid Sadazai appeared before the Divisional Bench D I Khan of PHC on behalf of the University of Agriculture who could not satisfy the court.
During the hearing, the court, while accepting both the requests of the petitioner Ahmed Ali Khan Advocate, stopped the vice chancellor of Agriculture University Masroor Elahi Babar from exercising any powers as VC Gomal University and suspended all orders and measures issued by him since September 19, 2022.
The Vice-Chancellor of Agriculture University stopped the implementation of all the notifications that he had issued as Acting Vice-Chancellor of Gomal University and suspended his appointment by issuing an injunction till October 24.
The honorable court said in its comments that this is a matter of the future of 4,000 students, so this case cannot be extended further, so before the next hearing on October 24, the Advocate General should submit an answer within a week.
Petitioner Ahmed Ali Advocate said that there is a conspiracy to divide the Gomal University and to thwart this conspiracy I myself have filed a petition in the court to stop the division of the Gomal University.
He said that there is a conflict of interests in both the universities, how can one side do justice and the Vice Chancellor of Agriculture University Masroor Elahi Babar is himself a party and he is not authorized to take decisions from both sides.
